These Terms & Conditions (“Terms”) govern your access to and use of ZenithPeak’s website at www.ZenithPeak.co and your purchase of any products from us. By accessing or using this website, you agree to be bound by these Terms. If you do not agree, do not use this website or purchase any products. 

1. Important Product Warning — Read Before Purchase

ZenithPeak sells botanical, hemp-derived, alkaloid-containing, and similar products which may include kratom (Mitragyna speciosa), 7-hydroxymitragynine (7-OH) products, functional mushrooms, hemp-derived cannabinoids, proprietary blends, and extracts (“Products”). 

These Products may be potent and may be habit-forming. Misuse may lead to dependence, tolerance, withdrawal symptoms, sedation, and other adverse effects. Effects vary by individual and by batch. By purchasing, you assume all risks described in these Terms. 

• For adults only — 21 years of age or older (or older if required by your jurisdiction) 

• Keep out of reach of children and pets 

• Do not use if pregnant, nursing, or under medical supervision without physician clearance 

2. FDA / FTC Disclaimer — No Medical Claims

Products and statements on www.ZenithPeak.co have not been evaluated by the U.S. Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, mitigate, or prevent any disease or health condition. 

Content on this site (including product descriptions, blog posts, FAQs, and reviews) is for informational purposes only and does not constitute medical advice. Consult a licensed healthcare professional before using any Product, particularly if you have a medical condition or take any medications. 

3. Age Restriction & Verification

You must be at least 21 years old to purchase any Product from ZenithPeak. By placing an order, you represent and warrant that you are 21 or older (or older as required by your jurisdiction). 

ZenithPeak may require age or identity verification at any time and may cancel orders or refuse service where verification cannot be confirmed. Misrepresenting your age is a material breach of these Terms and may result in permanent refusal of service. 

4. Safety Warnings — Responsible Use

Do not use our Products if you are: 

• Under 21 years of age 

• Pregnant, nursing, or trying to become pregnant 

• Under medical supervision for heart, liver, kidney, respiratory, neurological, psychiatric, or substance-use conditions (unless cleared by a licensed physician) 

• Taking prescription or over-the-counter medications that may interact 

Do not drive or operate machinery after using any Product. Do not combine Products with alcohol, opioids, benzodiazepines, or other psychoactive substances. You are solely responsible for safe use, storage, and handling. 

5. Legal Compliance & Prohibited Jurisdictions

Laws governing our Products vary by jurisdiction and change frequently. You are solely responsible for determining whether ordering, receiving, possessing, and using our Products is lawful in your location at all times. 

By placing an order, you represent and warrant that: 

• You are at least 21 years of age 

• Our Products are legal for you to purchase, receive, and possess at your shipping destination 

• You are not using forwarding services or misleading addresses to circumvent legal restrictions 

• All information you provide (identity, age, billing address, shipping address) is true and accurate 

ZenithPeak does not ship to states or localities where our Products are prohibited. See our Shipping Policy for the current list of restricted jurisdictions. If you provide false information or attempt to obtain Products in a prohibited area, you assume all legal and financial responsibility and ZenithPeak may cancel your order without refund. 

6. Retailer Status — We Are Not the Manufacturer

ZenithPeak is an independent retailer and reseller. We do not manufacture, formulate, or produce any third-party branded Products. All Products are manufactured by independent third-party manufacturers. 

To the fullest extent permitted by law, ZenithPeak disclaims liability for matters attributable to the manufacturer, including product formulation, potency, manufacturing defects, branding, counterfeit goods originating upstream, and regulatory compliance of the manufacturer. 

Any claims relating to manufacturing, authenticity, or product composition must be directed to the manufacturer or brand owner, not to us. Our sole obligation for a non-conforming product is, at our discretion, replacement or refund of the purchase price. 

7. Counterfeit & Authenticity Claims

If you believe a product you received may be counterfeit or misbranded, contact us promptly at support@ZenithPeak.co with your order number, photos of the packaging, and a description of your concern. We will investigate and may offer a replacement, store credit, or refund at our discretion. 

8. Orders, Pricing & Payment

ZenithPeak reserves the right to refuse service to anyone for any lawful reason, including suspected fraud, misrepresentation, or legal compliance concerns. Prices and availability may change without notice. If a pricing error occurs, we may cancel the order and refund any amount paid. 

For COD orders: if payment is refused at delivery, the order will be cancelled. Repeat COD refusals may result in account suspension. Fraudulent chargebacks may result in account bans and additional legal remedies. 

9. Shipping & Risk of Loss

Risk of loss passes to you when the package is delivered to the carrier. We are not responsible for carrier delays, failed deliveries, or seizures by authorities due to local laws. See our Shipping Policy for full details. 

International buyers and buyers in restricted areas are solely responsible for compliance with all import/export rules and local laws. No refunds or reshipments are guaranteed for packages confiscated due to legal restrictions. 

10. Returns & Refunds

Returns and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms by reference. By placing an order, you agree to the terms of that Policy. 

11. Third-Party Platforms & Automated Advertising

ZenithPeak advertises through third-party platforms that may use automated or AI-based systems to generate ad variations. We cannot review every automated variation in real time. If any advertisement appears inappropriate or misleading, contact us and we will review and may correct or remove the content. To the fullest extent permitted by law, ZenithPeak disclaims liability for indirect or consequential damages arising from third-party automated ad content. 

12. User Content & Reviews

Customer reviews and testimonials represent individual opinions and do not constitute medical claims. By submitting a review, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content for business purposes. 

13. No Warranties — Products Sold “As Is”

To the fullest extent permitted by law, all Products and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. 

14. Limitation of Liability

To the fullest extent permitted by law, ZenithPeak is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including medical outcomes, adverse reactions, misuse, mixing with other substances, or third-party conduct. ZenithPeak’s total liability for any claim is capped at the amount you paid for the specific Product(s) giving rise to the claim. 

15. Indemnification

You agree to indemnify and hold harmless ZenithPeak, its owners, employees, contractors, and affiliates from any claims, damages, penalties, losses, and attorney fees arising from your misuse of Products, violation of these Terms, misrepresentation of age or location, unlawful purchase or possession, or your content or statements. 

16. Intellectual Property

All website content (text, graphics, images, logos, layout, software) is owned by or licensed to ZenithPeak and is protected by applicable intellectual property laws. Third-party trademarks belong to their respective owners. Use of any trademark does not imply endorsement or affiliation unless explicitly stated. 

17. Dispute Resolution — Arbitration & Class Action Waiver

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS. 

Step 1 — Informal resolution (required first): 

Before filing any claim, you agree to send a written Notice of Dispute to support@ZenithPeak.co including your name, order number, a detailed description of the issue, and the specific relief requested. You agree to allow 60 days for good-faith informal resolution. 

Step 2 — Binding arbitration: 

If informal resolution fails, any dispute arising from these Terms, our Products, or your relationship with us shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its consumer rules. Arbitration will be on an individual basis only. 

Class action waiver: 

You and we waive the right to a jury trial and agree that claims must be brought only in your individual capacity — not as a class, collective, consolidated, or representative action. 

18. Governing Law & Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. For any court proceedings permitted under these Terms, venue will be in Clark County, Nevada. 

19. Changes to These Terms

ZenithPeak may update these Terms at any time by posting a revised version on the website. Continued use of the website or purchase of Products after changes are posted constitutes acceptance of the updated Terms.
